CEA Applauds Fifth Circuit Decision Striking Down Biden-Era Appliance Rule
Court Decision Protects Consumers from Costly Federal Mandates
WASHINGTON – Consumer Energy Alliance (CEA), the leading energy and environmental advocate for families and businesses, today applauded the U.S. Court of Appeals for the Fifth Circuit decision to strike down a Biden-era U.S. Department of Energy (DOE) rule establishing new federal efficiency standards on stoves, ovens, and cooktops. The court found DOE improperly used a streamlined rulemaking process that is intended only for rules that are not controversial.
The rule was one of several appliance regulations that CEA opposed because they would have made it more difficult for Americans to choose appliances that utilize affordable, reliable energy sources like natural gas and propane. CEA has consistently argued that families and small businesses, not Washington, should decide which appliances best meet their needs.
“This decision is an important reminder that federal agencies have to follow the law,” said CEA President David Holt. “The Department of Energy tried to use a process reserved for routine, noncontroversial rules even though there were significant objections. The court rightly held the agency accountable.”
Holt added, “Families deserve access to affordable, reliable energy choices, including natural gas and propane, and they should have the freedom to choose the appliances that work best for their homes and budgets. That’s good for consumers and good public policy.”
CEA supports policies that keep energy affordable, reliable, and available while protecting consumers’ ability to choose the products and energy sources that best meet their needs. Instead of one-size-fits-all mandates, policymakers should focus on expanding energy options, encouraging innovation, and keeping costs low for American families and small businesses.
